    You have up to two (2) years to file a lawsuit assuming this accident happened in California. You should certainly consult with an experienced personal injury attorney in your area regarding representing you on this matter and filing suit on your behalf. The opposing insurance company will appoint insurance defense counsel (either in-house or outside counsel) to represent the other person in the accident and it will be important to have a good lawyer to deal with that attorney and all of the other matters that arise in litigation.     It is very possible that the case against you has no merit and that a good attorney could arrange for you to be dismissed from the case early, on the basis that you are an improper defendant in the case and/or have no liability. However, you still should immediately retain a qualified attorney to review the entire matter with you and determine the appropriate strategy and response. A responsive pleading to the court complaint must be filed within thirty days of the date you were served or you can be defaulted on the case. It will take some time for your attorney to prepare such a response, so you should move on this quickly.

    You have a valid claim (and can sue, if needed) for the fair market value (FMV) of the 2009 car, as well as loss of use (essentially, reasonable rental value) but that will be time limited. Further information is needed, including the timing and status of the bankruptcy petition, in order to fully answer your questions. You also have a claim for your medical bills, pain and suffering and lost earnings (if applicable). There are complexities here and you should get an attorney involved who is in your area and has experience in these matters.
