Description: In post-dissolution of marriage proceedings, the parties had an exchange of correspondence. This exchange included a written promise by the ex-husband regarding support. The ex-husband argued the writting was not a settlement agreement and could not be enforced. Mr. Abel, who represented the petitioner, ex-wife, argued that the writing was an enforceable settlement agreement under the Family Code and the Code of Civil Procedure. Agreeing with Mr. Abel, the trial court agreed found the writing an enforceable settlement agreement. Husband appealed. On appeal, the parties made the same arguments to the California Court of Appeal. Mr. Abel's argument was adopted by the Appellate Court who affirmed the judgment.
