Description: Mr. Barr's wife (63 years old) died after a car accident and complications from resulting surgery. At the time of the accident, the driver was on an errand for the defendant. On his own, Mr. Barr settled the wrongful death claim with the driver's carrier and signed a release. In addition to the driver, the defendant was named as a released party in the release. Mr. Durrrett was able to convince the trial court that the signed release only operated to release the defendant for coverage under the driver's policy, but not as to liability or coverage under the defendant's policy.
