    Patricia’s Answer

If there are issues with your current placement those should be communicated to your caseworker during your monthly visit. Not liking a placement is not a reason to move placements, especially if you are close to graduating. Sometimes alternative placement arrangements can be made to ensure every opportunity is available for you to receive the benefits you are entitled to receive upon aging out and for your future. You must communicate with your caseworker for them to know what's going on and how to help you. Good luck.

I just had this question in my office yesterday. The school holidays only occur during the school year. The last day of school ends the school year. So, after the last day of school visitation has to follow the not in school periods of possession. Under standard order, visitation would begin at 6:00 p.m. on Friday. Without seeing the order, I can not be more specific. You should speak with a good family law attorney in your area to be sure.

  • How long does it normally take to actually go to court once you have filled for modification in Harris county ?

Explain process and and time line till court date?

    Patricia’s Answer

There are a lot of variable. What Court are you in? There are 9 in Harris County, and each has a different length of time on moving their docket. Is this case agreed or not? If agreed, it can happen as soon as the paperwork is signed by everyone. If not agreed, it can take as long as a year. There are deadlines that must be met, and depending on what you are modifying, other actions that must occur. Talk with a good family law attorney about your options.

  • My spouse filed non-suit on a divorce case that was scheduled for trial 3 days prior to the court date. The judge signed it.

It passed, my question is can the spouse reopen the case if the spouse decides to go through with the divorce without starting the process all over again. I would also like to know if I can file a petition for a divorce against the spouse.

    Patricia’s Answer

A non-suit is effective on filing, whether the Judge signs it or not. If no Counterpetition is on file, then the case is gone, and it must be refiled as a new suit. In some cases, if there is an agreement ready to prove up, and 30 days have not passed, the case can be reopened.

You can always file a new divorce petition. Talk with a good family law attorney about your options.

There aren't enough facts here, and I don't do immigration work, but if you didn't file within a certain time period of separating, the presumption is there was no marriage. Take the facts to a good family law attorney to get a definitive answer.
