    How can I find out if my ex-wife filed for child custody and child support in the state of texas. she lives in Missouri city, Tx. what court can I check for proceedings.

    Patricia’s Answer

    If she lives in Missouri City the case would be filed in Fort Bend County. You can check with the District Clerk to see if a case has been filed, but if it is a recent filing, they can't tell you. You will be served if she has filed. You should talk with a good family law attorney to see what your options are.

    There are a number of factors involved in terminating a parent's rights. Most courts won't terminate without an adoption. Talk with a good family attorney about your options about how to end the situation.

    Child support is based on the payor's income. There is a formula to calculate how much, but in simple terms it is 35% of his adjusted gross income. For spousal support, there are a number of factors, but it is certainly possible. You should talk to a good family lawyer to discuss your options in detail, but filing a divorce is a good first step.

    The husband or your ex can file a paternity action at any time. You may have some defenses against paying back support, but you would have to pay ongoing support if you are tested and you are the father. There is nothing you can do now that would stop her from coming after you later, and it would start things up now instead of later. Talk to a good family law attorney to discuss your options.

    Don't sign anything. The court order is enforceable as written. If she doesn't turn over your child, then she can go to jail. You should contact a good family law attorney to go over your options.

    A house purchased during the marriage is community property, but if you used separate funds to purchase it, you may be entitled to reimbursement. How long you lived together isn't the question. Living together or not, you are still married and therefore 1/2 of what you accumulate is hers. Get divorced now. Talk with a good family law attorney about your options.

    If you marry woman 1, then marry woman 2, then you are guilty of bigamy (it doesn't matter what name you use). When the marriage to woman 1 ends, the marriage to woman 2 immediately becomes a valid marriage. (it is void until then). If you want to be sure, either remarry or file the certificate the previous answer suggested.

    I agree with attorney Busby. However, if you know where he is, you will need to have him served. There are ways to do it. Call a good family law attorney to get it done right.

    If he failed to answer a properly served modification petition, then a default Order should be entered. This is a complex area and you should really talk with a good family law attorney.

    This is a complicated situation. You should talk with a good family law attorney. Does your custody order have a geographic restriction? If not, you should go back to Court and have one added. This will prevent her from moving the residence of the children outside of a geographic area. Most Harris County Courts take these very seriously. You also should have an attorney look at your final order concerning the defamation. If there is an injunction, it can be enforced. If not, one should be added. I have changed custody from Mom to Dad because of violations like these.
