I think you should focus your efforts on finding new counsel for your civil case. If the trial settings very near, you will need to request that the trial date be postponed. Depending on how much time the court has already given you, the court might not be receptive to giving you more time. Also, the defense might very well move for dismissal of the case (through a motion for summary judgment) if they think they can get away with it. Do I have grounds to sue someone for selling me a damaged motorcycle that almost caused me an accident?

If you bought the bike "as is" then you might be out of luck. If the seller made representations that were false, them you might have grounds to sue for breach of warranty or DTPA. You wold need to seek out a lawyer experienced in those type claims. This question was posted in the personal injury section. Car accident, at fault, no insurance

Normally, the owner of the damaged car would get to choose the repair shop. However, since you are paying cash out of pocket, I think it is fair to ask her to go to a shop of your choice for an estimate. Whatever you do, make sure that you get a release signed by the other driver before you pay money. I don't think it matters if you pay him or the shop. If you don't get a release and the matter goes to court, yes court costs are recoverable. But this sounds like a matter that will resolve...

Yes, sending by certified mail, return receipt requested is the best way to prove that he received notice of the hearing. It will cost about $6.00, but worth it if you can have the hearing and be able to tell the court your side. You can also fax it if he has provided a fax number to the court. Still being Treated by doctors and not released to return to work yet

Good questions. You should first use your health insurance. Second, if you have balances, you can pay them, use your PIP if you carry that type of insurance on your auto policy, or possibly put the balance on some sort or payout. Any of these will keep the event from going on your credit. In the end, should the injury claim resolve to your satisfaction, you can then pay off balances--or pay yourself back, whatever the case may be. I see you are from Fort Worth. I know from experience here...

Police report does not match with what witness and victim say Happened

I would definitely contact the officer who wrote the report and get your story heard. More often than not it does not change the report, but I have indeed had multiple clients who convinced the officer to at least write a supplement to the report. On occasion, the officer will just flat out not respond. If that happens to you, then I would suggest that you contact the officer's supervisor. I have seen that help get your story heard. Be persistent. It just might pay off.

I was rear-ended in Texas and was deemed not at fault, but my insurance premiums will increase. Can I recover the difference?

Unfortunately, this is not a recoverable damage in Texas. It probably should be, but it isn't. You did all the right things by getting the license and the police report. However, you are out of luck on this particular issue.

Can we buy a house during a pending lawsuit?

Yes, you should be able to purchase the house and do other things to keep living your life as you need to live it. I do not know the potential value of the claim against you so I do not know if the insurance you have is adequate to address the loss. You might want to contact the lawyer hired by the insurance company to fight the lawsuit and ask him or her what is the amount claimed and do they think the insurance you have is enough to cover the claim.
