Can I sue the retailer or manufacturer for a defective product

Asked by a user in Houston, TX - almost 3 years ago.

You may want to contact a personal injury attorney to discuss this situation further. This is a very unusual situation to say the least. It's possible if you contact the store and the manufacturer of the tampons they may offer you sufficient compensation that there is no need to hire an attorney. How you proceed depends on what kind of response/compensation you are expecting from the store and/or manufacturer. If you have additional questions, feel free to contact me....

Medical negligence, wrongful death, malpractice

Asked by a user in Dallas, TX - over 3 years ago.

The short answer is "yes", an attorney in Amarillo would be able to work the widow's case. However, location of the attorney may not be as important as the attorney's competence in the particular area of law. Further, the case may need to be filed in Dallas as the alleged malpractice occurred there. A Dallas attorney may be more familiar with the courts and judges, and thus better able to prosecute the decedent's claims against the health care providers. In either case, interview and...

Can a grocery store be liable for damage vehicle cause by shopping carts?

Asked by a user in Dallas, TX - almost 3 years ago.

Karen, More information is needed to fully answer your question. For example, were the carts that struck your car left in the parking lot by other customers? Also, "acts of god" such as sudden storm may relieve the grocery store from liability. Given that the store has denied liability, I would recommend that you contact an attorney to discuss your options. _____________________ This response is for informational purposes only and is not, nor is it intended to be legal advice. Can inurance co. avoid paying even when police report indicate aacident caused by their client?

Asked by a user in Plano, TX - almost 3 years ago.

Did your daughter have insurance at the time of the accident? If so, you should notify them immediately. They may cover (at least until liability is determined) the rental car costs and medical treatment for your daughter. A police report is not conclusive evidence of fault in an accident, especially in a case where witnesses disagree about who was at fault. Therefore, the other insurance company is within their rights to investigate liability prior to paying your claims. If your...

How much can I be sued for?

Asked by a user in Jacksonville, TX - almost 3 years ago.

The short answer to your question is yes, you can be sued for more than what your insurance covers. The reality of the situation is that if you don't have the assets to cover a judgment that is over and above the insurance amount, the attorneys representing the other parties may not pursue the extra amount very vigorously. As explained by other attorneys responding to your question, it is very important to stay in contact with your insurance company and follow the progress of the claim in...

I filed, pro se, a wrongful death civil suit in alabama as rep of my son's estate on last day SOL.

Asked by a user in Birmingham, AL - almost 3 years ago.

I would agree with the previous attorneys' answers. Filing as the representative of an estate is sometimes trickier than filing as an individual. I would recommend contacting a lawyer as soon as you can to make sure the lawsuit is correctly filed. Contact your local bar association for referrals. ________________________________ This response is for informational purposes only and is not, nor is it intended to be legal advice. My son was a victim of a hit and run but he was able to get the license plate number what should he do?

Asked by a user in Austin, TX - almost 3 years ago.

You/your son should file a report with the police and provide them with the license plate number. Also, give the license plate number to your insurance company. The police and/or your insurance company should be able to determine if they other driver was covered by insurance and if they are you can make a claim against the hit and run driver's insurance company. _____________________ This response is for informational purposes only and is not, nor is it intended to be legal advice. How do i prove liability?

Asked by a user in Houston, TX - almost 3 years ago.

More information is needed to answer your question. Did the police come to the scene of the accident? If so, what does their report say? Who did they fault for the accident? Were there any witnesses? Basically it will take an independent third party to end the he said/she said debate. Absent an unbiased witness it might take a jury to determine fault. __________________ This response is for informational purposes only and is not, nor is it intended to be legal advice. My son was injured in auto accident. what is paid by auto insurance? What happens when health insurance is subrogates?

Asked by a user in Longview, TX - almost 3 years ago.

I agree with Marc's recommendation to seek the advice of a lawyer. In a case like this where there are multiple insurance companies/policies involved, an experienced personal injury lawyer can help you navigate the complexities of your son's settlement(s). _________________________________ This response is for informational purposes only and is not, nor is it intended to be legal advice.
