They may cover (at least until liability is determined) the rental car costs and medical treatment for your daughter.     I would agree with the previous attorneys' answers. Filing as the representative of an estate is sometimes trickier than filing as an individual.     You/your son should file a report with the police and provide them with the license plate number. Also, give the license plate number to your insurance company.     More information is needed to answer your question. Did the police come to the scene of the accident? If so, what does their report say? Who did they fault for the accident? Were there any witnesses? Basically it will take an independent third party to end the he said/she said debate.
