    It's not something a judge should do, but it the judge does throw you in jail for not pleading then your lawyer needs to be ready to protect you. I'd talk to your attorney about what his plans are if the judge follows through with this threat.

    Defense lawyers are usually required to appear in multiple courts at the same time, which is impossible. For example, in Dallas all the misdemeanor settings are at 9, and as a defense lawyer I can set in 5 different courts that morning. I"ll be late to at least 4 of them and the judges understand that. Unless it is a jury trial setting I wouldn't be too worried about it. It sounds like an announcement setting in which you appear and then reset the case so both parties can work on the case more.

    It's hard to walk someone through the civil litigation process on Avvo. This forum is for general Q&A questions, what you are asking is for someone to tell you how to litigate a debt defense case, which is beyond the scope of this forum. The reason is that the answer you seek depends on the facts of your case, which we don't know. I know you believe you can not afford a lawyer but I would encourage you to call around and see if anyone can work with your budget.

    This sounds like one charge. Assault causing bodily injury/family violence can be a single offense if there is only one complaining witness involved. Family violence cases in Dallas can be dismissed given the right circumstances. The result of any individual case is impossible to predict. His lawyer should receive a copy of the 911 call during the discovery process. If you are in an abusive relationship and you are scared of your husband you should visit with a local family to discuss your options. Also, you husbands bail may include a protective or restraining order that limits his ability to live with you or be around you. Violating that order, or any condition of his bond could land him back in jail.

    I know that DIY divorces are all the rage these days, but if you are filing your own motions and you can't locate a fiat, it should be a sign that maybe you need an experienced local family lawyer to assist. Pro se litigants are routinely slaughtered in Texas courts. Don't let that happen to you. I know that family lawyers are expensive, and no one likes paying attorneys fees, but a divorce can affect the rest of you life, and it's worth investing in to get the best result. Trust me, our firm has seen many former pro se litigants who got terrible results from their divorce case and come in to ask about appeals, or how to fix what happened.

    Instead of focusing on potentially errors on the DIC 24, the more important issue you are facing a felony DWI charge and you do not have a lawyer assisting you. DWI 3rd is a 3rd degree felony, if convicted you could face 2-10 years in prison. Do not wait until you have a court date coming up, hire the best local DWI attorney you can afford. This is a legal emergency and you need help now. Don't be another victim of our State's broken criminal justice system, get a lawyer to fight for you and protect your rights.

    Most family lawyers in Collin County offer free consultations, you should meet a local experienced family lawyer to develop a plan to protect you in case this relationship can not be salvaged.. I also agree with the earlier answer that you need a marriage counselor to try and repair the trust issues in your marriage.
