If you are married and wish to obtain a divorce or legal seperation you should contact an attorney because your attorney will need to draft and file pleadings with the Court.

You should speak to a local attorney about the possibility of filing a Motion for Contempt against your ex for his failure to follow the divorce decree. Also, if the creditor files a lawsuit against you for the debt, you may be able to file a cross claim against your ex in the collections lawsuit.

My question to you would be where was the last state where they both lived together and how long did they live there together? If your son has been in Missouri more than 90 day then he can file the divorce in Missouri. But, if the parties did not live together in Missouri and if the Court cannot obtain the proper jurisdiction over the Wife then the Missouri court may not be able to decide some financial issues.
