Description: Death penalty prosecution for 1st Degree Murder charge involving allegations of abduction of a Mother from parking lot with infant child found alive in car. Body found in nearby cornfield. Prior to trial Defendant was convicted of rape of local realtor during house showing and sentenced to 52 years in DOC. Dna evidence suggested 3 Trillion to 1 identification of Defendant. Jury trial of approximately 5 weeks was moved to Peoria due to pre-trial publicity concerns.Through pre-trial and trial strategy regarding timing of case jury's imposition of Death Penalty was avoided through post trial petition.
