If the case is properly expunged, the order of the court states that the arresting police agency shall destroy all records of the arrest. There should be nothing on the computer to see.

No, it is not grounds for a dismissal. The prosecutor can amend the ticket at any time prior to trial. The clerk was just coding the ticket into a computer system.

You can only get the court-ordered restitution while the defendant is still on probation. However, there may have been a judgment entered by the court for unpaid restitution. If so, you can civilly seek to collect on that judgment.

In my experience, your command could find out. You can be separately punished by the military for the civilian offense. I have seen things go very badly for service personnel in this situation. You should make sure you have a lawyer when you go to court.

The only way to change a charge 5 years after a conviction is to get the prosecutor and judge to agree to vacate the conviction and reduce the charge. That is very difficult and would require your attorney to have an good relationship with the prosecutor and some compelling reasons for the reduction.

It's easy to say hire a lawyer, but let's answer the question. The best thing that can happen is that your lawyer will find a basis to suppress the breath test which will make it much easier to win your case. In that process your lawyer should also seek to rescind the summary suspension of your driver's license. If the arrest was actually expunged, it will not show up. However, you can check this by calling the Illinois State Police Bureau of Identification in Springfield, Illinois.
A competent attorney should be able to clear this up. You need to make sure that you don't rreceive a conviction on the driving suspended charge, since that could cause a new suspension.
