    Client's husband engaged in extra-marital affair. Parties had small children. Client upset by newspaper article with picture of spouse with "friend". Shortly thereafter, "friends" dog bit one of the children. This case had all the makings of an expensive, contentious battle. Instead, the parties were able to place the focus on the needs of their children; remain respectful of one another. Both parties were happy they pursued collaborative process and so was their pocket book. Parties utilized child specialist to keep focus on the children.

    Description:
    Client's former wife obtained Ex Parte Order terminating joint physical custody, granting former spouse primary custody, and providing supervised parenting time to client on allegations client alleged were false. Former spouse also obtained ex parte personal protection order. Through investigation and due diligence, the Court was provided with facts which persuaded the Court to vacate its ex parte Order, re-establishing joint physical custody and equal parenting schedule to client. Opposing counsel was persuaded to terminate PPO issued against client into Mutual Restraining Order, effectively protecting my client.

    Joint legal, joint physical custody with parenting time in blocks of 3 or 4 overnights was modified after Mom denied parenting time to Dad; moved approximately 9x in 18 months; didn't administer medication as directed; failed to maintain sanitary living conditions while abusing substances and not maintaining employment. Proper cause established to review custody and parenting time. Clear and convincing evidence to modify custody to Dad.
