V. W v. Tommy Walls

Outcome: Order of custody/support dismissed.

Description: Twelve year old custody/support order was set aside after discovery in companion criminal case led to new evidence. Mother that brought case was married to another man when children were born. The Court had no jurisdiction over the children and/or Mr. Walls. Mr. Walls had been thrown in jail and paid some support over the previous twelve years improperly. Evidence was produced in trial preparation process for the criminal case which established that the mother was married. Criminal case was dismissed and then this civil case order was set aside. Arrearage was removed and case was closed.
