The value of buying my wife out of my pension was $90,000 in 2002 when we divorce. She is receiving $1400 per month. In 5.4 years that amount she will have received. Will I then begin after 5.4 years receive that $1400 per month?

No lawyer is able to answer this question without first reviewing your Judgment of Divorce. Your answer should be located in that document.

    David’s Answer

A lawyer will need to review the agreement and discuss the specific facts with you prior to rendering an opinion. As a general rule, however, an entity may assign its rights. Feel free to contact us to discuss further. (248) 758-2323. www.davidsebastianlaw.com.

    David’s Answer

Before you can file a motion for child support, you need to file a Complaint for Divorce. Then, you may seek child support, spousal support and restraining orders to stop the abuse, if necessary. Feel free to call our office for a free consultation. (248) 748-2323. www.davidsebastianlaw.com.

  • Can my spouse sell marital assets without my consent? We purchased a truck while we were married and the title is in here name.

My wife has taken my truck and sold it without my consent. The truck was purchased while we were married. I drive the truck everyday and make the payments.

    David’s Answer

If the title is in her name, she can sell it. If you are contemplating divorce, you should retain counsel immediately to stop her further selling of assets. Feel free to contact us for a free consultation. www.davidsebastianlaw.com. (248) 758-2323.

  • How do i fight a bogus PPO?

my wife has an ex parte ordered PPO against me. I filed to have a hearing not because i want to have anything to do with her but because i'm afraid she'll falsely accuse me of breaking the order. Hearing is on the 24th of this month and i would ...

    David’s Answer

Defense of a PPO is very fact specific, and requires that you sufficiently refute your soon-to-be ex-wife's allegations. Although you may have already agreed upon a property settlement, your ex-wife may be seeking to use the PPO proceedings against you in a dispute over custody and child support. You should retain counsel immediately. Please feel free to call our office for a free telephone consultation. www.davidsebastianlaw.com. (248) 758-2323.

  • How much of this will weigh in my favor during a custody battle? what may go wrong? Can i get full custody?

My wife and i have been separated (living in separate households since i don't think Michigan recognizes legal separation) since April 12th. She claims she began dating a coworker a week after moving out. She shares her parenting time with this ...

    David’s Answer

Yes, you may ask the Court for sole custody. IF your soon-to-be ex-wife has "borderline personality disorder", and "a history of lying and theft", these are obviously NOT character traits that will benefit her in a custody battle. You should retain counsel as soon as possible. Please feel free to call our office for a free consultation. www.davidsebastianlaw.com. (248) 758-2323.

    David’s Answer

As you might expect, your question is not so easily answered. If you do not care that your business LLC will suffer the entry of a Default Judgment if you ignore the lawsuit, then you probably don't need to worry about it. There are a number of factors to consider when deciding how (or if) to defend a lawsuit, and you would need to provide more information for us to assist you further.
