Description: After petitioner's first-degree murder conviction and sentence as adult to life imprisonment without parole were affirmed on direct appeal, 221 Mich.App. 551, 562 N.W.2d 241, petitioner filed for habeas relief. The United States District Court granted conditional writ of habeas corpus. Government appealed. The Court of Appeals, Bright, Circuit Judge, held that: (1) defense counsel's performance was deficient, and (2) defense counsel's deficient performance prejudiced petitioner. 299 F3d 588 (CA6, 2002).
