Description: After the verdict against the wrongdoer suit was brought against the wrongdoers insurance carrier for bad faith. Bad Faith was alleged to be the failure to settle the case for a demand against the insured within the policy limit. Every insurance company owes a duty of good faith to its insured if it breeches that duty the insured has a right to bring a claim against their own insured. That claim can be assigned which if done allows the injured victim to bring the case agaoinst the carrier who did not pay the demand.
