Can I get a theft charge expunged if it has been over a year, but I also have a ovi charge that happened after the theft?

Generally speaking in Ohio if you have an OVI conviction, then you are no longer a first time offender for the purpose of sealing a prior conviction. If you are not convicted of the OVI, and a person has no other convictions, then they are considered a first time offender and can apply to have their prior conviction sealed. You should retain counsel to look at your specific case.
