Description:The client in this case was stopped for a traffic violation and had open containers of alcohol in his car. After performing field sobriety tests, the police officer charged my client with DUI. Client tested positive for a very low amount of alcohol on a breathalyzer test and was not given a blood test. The officer still pursued the DUI charge on the theory that client was under the influence of some other substance. After preparing the case for trial and lengthy negotiations with the prosecutor, the State agreed to dismiss the charge for lack of evidence.
