  • Should we pay our credit cards off or keep a small balance?

Ok, so my husband and I are debating about this all the time and I want some answers. My husband keeps saying that keeping a small balance ($200) on his credit card is better (credit score + credit history) than paying the card off every month. I ...

I have been told not to have more than three store cards and never have more than 1/2 the balance charged to have the best effect on your credit. I'd keep charging and keep paying them in full personally.

  • If I am in Chapter 13 bankruptcy and if my plan is completed (x number of years plan) and at the discharge hearing or prep for

discharge the fact comes out my mortgage went unpaid for half the time of the plan, what happens? Do they simply extend the plan to the 5 year maximum with a newly determined wage garnishment? Do they force me into chapter 7 at that point and for...

    Lois’s Answer

I have seen judges dismiss bankruptcy cases for people that were behind in their mortgage at the end of the chapter 13 case. My advise is to try to get a loan modification approved now or like the other attorney said get a family member to help you catch up. I have seen this several times that someone could get months and months behind and the creditors fail to act. About 1/2 the time the creditors will contact us and eventually file a motion for relief from stay if the debtors don't catch up. Don't sit back and do nothing.

can I go to jail if I go get car back, I have paperwork from court saying its my car, but she has the title

    Lois’s Answer

I agree that if u can get the police to go with you go. Getting your lawyer to send her lawyer a letter is another remedy and taking her to court for a rule nisi for not obeying the court order if those two things don't work is next.

Any attorney including us would need to look at your paperwork to be sure and ask you various jurisdictional questions. If we cannot do it we can refer you to a Georgia attorney or you can search for one on AVVO.

  • Husband had an unsecured line of credit loan with a bank. He is now deceased, am I now responsible for this debt?

This loan was made over the phone, and I don't recall any paper work being sent for signatures. I always made the payments on line, and since his death, I cannot access the account. The loan was in his name only. Is this a debt that I am responsib...

    Lois’s Answer

I have added probate to your area as you need to check with a probate attorney in your state. While in Alabama you would not be personally liable the debt could attach to his estate if he has any assets.

  • My hubby has a accident on his record and can't get a licsense. He is wanting to file bankrupcty to take care of it.

The accident happened in Alabama. He is living in Alabama. The lawyer is willing to make payments on it. He owes 2200.00. He is wanting to file bankrupcy and wants to know if it will cover it so he can get his licsense back. This all happened 8 ye...

    Lois’s Answer

Yes it will but a bankruptcy will cost you at least $1200.00 and maybe more and if there is nothing else on his record and the attorney will give him his license back and let him make payments on it, make payments on it. I have to assume he took a judgment on him because there may be a technical way out of this if there is no judgment and its been 8 years. It could simply be too late to collect the debt. Has he gone down and just tried to get his license back? Or has he made payments over the years as that could revive the debt too? Did he sign a contract agreeing to pay this back and has made sporadic payments? There are too many unknowns. You need to go talk to a lawyer and give them specifics.

Your WC settlement if the paperwork provides for open medical benefits will entitle you to medical care for lifetime assuming no new injury. Have you applied for social security disability? Also have you gone back to your last doctor and asked for medical treatment again? Did you close your medical when you settled your worker's compensation case? You could make an appointment with your lawyer. If these two things faile bring in your wc paperwork to me or another attorney and let us look at it and advise you better.

    Lois’s Answer

You will need to hire an attorney to review the paperwork that you were served with. The paperwork will tell you the number of days you have to file a responsive answer, which will in all likelihood be a denial. When your children were legally adopted the ex cut off all rights to them. If you do not answer the paperwork however she could possibly get rights by default.

  • I live in Alabama but my DL is suspended in georgia. I got fines i haven't paid and it's been 5 or more years what do I do?

I'm originally from georgia . I moved to Alabama about 9 years ago. I need my DL to go further in my career. My job is requiring me to get them. I also violated probation in douglasville,ga cause the p.o. Would not transfer the probation to Alabam...

    Lois’s Answer

You need to resolve the underlying reason for the probation violation as soon as you can which sounds like you need to pay all the fines and costs in full. This will probably mean turning yourself in to the court and dealing with the issues involved which may or may not mean jail time. Of course if they catch up to you first, you are going to jail here, and then if Georgia will come get you, you will sit in jail waiting on extradition, and then you will sit in jail in Georgia waiting on a court date for the probable failure to appear that you have picked up. Save up some money immediately to pay the court and the attorney you need to hire. Get car insurance yesterday if you do not have it, and talk to an attorney in that city with experience in handling these type of matters. Discuss the circumstances in private with suitable counsel immediately.
