    unfortunately under the graves amendment the rental car companies have immunity unless you can show they were actively negligent. with that said the rental car companies are required to provide 10k in liability coverage that you may be entitled to. also you need to see of the driver of the rental car has his own insurance or purchased insurance through the rental car company

    in florida we have a 4 year statute of limitations for negligence claims. you are well within the statute however i would strongly suggest that you begin this process, it is important to put the homeowners insurance on notice of the claim, they may have a medical payments policy that could defer some of your medical expenses. it is important to protect your sons future, and help him get compensated for his loss

    i strongly suggest that you retain an attorney immediately, it sounds like your wife has suffered permanent damage to her scalp. it is my opinion that this national chain probably carries liabiity insurance to cover this loss. my suggestion is to begin your claim immediately. make sure you wife saves the receipt or keeps a copy of the credit card receipt

    unfortunately if your uncles insurance company does not pay for the damage you are responsible to the insurance company for the damages to there car. if you have your own auto insurance policy you may submit the damage to your insurance company and pay the deductible or get the money from your uncle who caused the damage

    the answer is not that simple, the first question is how much bodily injury insurance does the at fault driver and owner carry, do you have uninsured/underinsured motorist coverage, the next question is have you sent a demand letter to the at fault parties insurance carry for there policy limits an given them a time limit to respond. if the at fault party only carries 10k in bodily injury coverage and they have no attachable assets and the insurance company tendered within the time frames in your demand and you don't have UM coverage then probably yes, if the answer to any one of the questions is no they you may be able to recover more.
