You can all an attorney to do what is called a Petition for Family Name Change which will change everyone's name in one Case and Filing Fee. You could also fill out the paperwork on your own. Everyone can change their name so long as no one is a convicted felon, doing the name change for illegal purposes or have been discharged in bankruptcy.

You may want to check the clerk docket to see if she has taken a Domestic Violence Injunction against you. In that case you would not be allowed back in the House. I don't believe there is much you can do. You should be able to go back because that is the "marital home". However if she has an injunction against domestic violence issued against you, you will not be able to return to your home. He can try to do so. However he has to prove to the Judge that it is not in the best interests of the children to be around this person. It would be up to the discretion of the Judge. I do not think alone that being an undocumented immigrant would rise to the level of removing the children or having to kick your fiance out of the house. I would also suggest that your fiance seek advice from an immigration attorney. If he becomes documented and a legal resident then the problem will not exist.
