Whether the force utilized is justified depends upon the facts, and what reasonable suspicion the officer had at the time the force was applied. There is a possible cause of action, but whether there are recoverable damages depends upon your injury or detention. You should discuss the specifics with an attorney to have your question properly answered.

  • Can the wife who is separated from her husband in Georgia take their 3 year old son into Florida to live with her

even against husbands objection? there are currently no court orders or aggreements

    Paul’s Answer

More information is needed to fully answer the question. Where has the child been living? How long has the child been in Florida? Assuming that the child spent most of its life in Georgia, with both parents, you should contact a licensed atty in Ga. The parent who has removed the child should seek legal counsel as soon as possible.

  • If my probation officer doesn't violate me on something and then months later his boss tells him to can my attorney argue that

my probation officer said I didn't violate something and just told me not to do it again and now months later his boss is telling him to

    Paul’s Answer

If you are cited for a probation violation, you would still be entitled to a hearing before the Judge who would ultimately make the determination as to whether you were in violation of the terms of your probation. The opinion of the officer may be a factor in determining whether you violated your probation and as to what puinishment should be imposed. You should consult wiith an attorney to determine the exact practice employed in your area, and to be prepared if action is taken against you.
