If the defendant committed perjury, or your attorney can prove they intentionally lied in their deposition, then a motion for sanctions, including striking their pleadings can be filed and the judge can enter a judgment in your favor. This is very rare in the State of Florida, but it has and can happen. It may be worth a try if you have strong evidence that the defendant was intentionally untruthful.

The value of a case depends more on the amount of treatment that your family has had, rather than the amount of the bills. For instance, if they only went to the emergency room once, then never treated again the case has minimal value and $1,000.00 above the bills is probably fair. On the other hand, if your family has multiple treatments over a 6 to 8 week period, and a physician will give an opinion that they sustained some degree of permanent injury, then the case would be worth more.
