  • I called the police on my friend and they are charging him with DV and have a warrant for his arrest how do I drop it all.

The police took pictures of the bruise I have. My friend left the scene and he has charges against him from myself and the police and I want to drop them all

    John’s Answer

Is this person just a friend or were you in a relationship with him? Domestic violence can only happen by familial or dating relationship. You can tell the police that you don't want to pursue the charges, but if they have independent evidence, ie. bruises, 911 call, witnesses, etc.

    John’s Answer

The answer is yes. The case may still be prosecuted. It is not the victim's right to pursue or decline the charges. The State may still be able to prove their case if they have a 911 call or if there was a recorded statement close in time to the incident happening and the victim was still under the stress of the incident. The no contact orders can be difficult to remove because no judge wants to wake up the next morning and find that the no contact order he dissolved had caused the alleged victim harm or death.

    John’s Answer

What your husband did was commit the crime of false imprisonment. The fact that your husband shook a wine bottle at you and it splashed in you may be considered domestic violence since he in a sense touched you with the wine without your consent.
