Description: Defendant Purvis Taylor was tried and convicted of DUI manslaughter. A motion for new trial was made and a hearing held upon "newly discovered evidence" which was not available to the defense at the time of trial. Trial court denied the Motion and an appeal was taken on the issue of "newly discovered evidence." The Appeals Court reversed and remanded. The state thereafter entered a Nolle Prosequi.
