If my husband and I both file for divorce at the same time, who becomes Petitioner?

Most times, the Clerk's office will not let both parties file for the divorce. They will alert the second party that a divorce case has already been filed with the Court. In the event that both petitions get filed, the case with the lowest case number is usually allowed to go forward. There should be no preference given based on a party being pro se or having an attorney.

My child mother died giving birth to my child and i didn't sign the birth certificate and now there trying to take relocate her?

You need to immediately file a petition for the Court to establish paternity of this child. The Grandma or whoever has this child will have to be served with these papers. You will be asking the Court to order a paternity test immediately and if the child is yours, order that the child is placed in your care. Is there a typical or age-appropriate schedule for a 23 month old that I have shared physical custody of?

There is no typical schedule for any child. The Court is supposed to look at the particular circumstances of the parents and the child to figure out what schedule is in the best interest of the child. If you live only 5 mins away from your son...... the Court maybe able to be creative in the visitation arrangement. Of course, the Court will have to take in consideration.. the parent's work schedule, if the parents get along...... among other things. Going from Mom to Dad and from Dad to Mom...

How can i change my daughter's last name to mine?

You will have to file a petition for name change with the Court. You will have to serve a copy of the petition on the father.The father will then have an opportunity to agree or disagree to the name change. If the father agrees, y ou both need to sign that you agree and bring the agreement to Court to get a final order. If the father disagrees,the Court will then have to decide if it is in the best interest of the minor child to change the child's last name. Good Luck

Is there anyway to file for child support without my husband knowing in what state i'm living.

You do not need to wait six months to file for child support. Because of the nature of child support, the law provides that you can file your child support petition at any time, any State. You may use a private attorney or you may file child support with Department of Revenue. They are located in downtown Orlando. The cost is minimal.
