  • Is a limousine carrier's insurer subject to a direct action in Georgia?

Is a limousine carrier's insurer subject to a direct action in Georgia?

    Jeffrey’s Answer

Georgia law allows a direct action against the insurance company of a "motor carrier." Limousines are motor carriers under Georgia law. An exemption might apply to the limo or it might not, depending on the use of the limo. This is a heavily litigated topic and depends on the facts. Jeff Shiver

  • How can I be assured that I am receiving a fair settlement?

I have decided to let the other party offer their dollar amount first because I am not sure how high they will go. I didn't want to under bid. I am not sure what my case is worth but I have a ballpark figure in mind

    Jeffrey’s Answer

Case values are highly dependent on facts, injuries, etc. The smaller the case, the less likely a lawyer needs to be involved. If Damages are significant, broken bones or surgical, you can bet that hiring a lawyer will net you more money, even after lawyer fees.

  • Who is liable? I was in an accident with a tractor trailer transporting cars for a large car manufacturer. I've lost a finger

and use of my left arm. And am no longer able to work. Can I sue the driver, the trucking company and auto manufacturer?

Absolutely. You can sue the driver, the company he was driving for, and in most cases, the insurance company directly. We often find evidence that the driver had a history of dangerous driving and the company either knew, or should have known, which often allows us to seek punitive damages. You will likely need a competent commercial vehicle lawyer. Make sure your lawyer has vast experience, and large verdicts and settlements specifically involving tractor-trailer crash cases.

Whether you have a claim against an apartment complex is highly dependent on the facts. If that particular apartment complex was the location of criminal activity, and you can establish the management or owners knew about the criminal activity and did not do anything to prevent it from continuing to occur, you most likely have a good case. You must also establish that you were authorized to be on the property, either a tenant yourself or were there visiting someone who lives at the complex. We just recently settled a case against an apartment complex in Atlanta where someone was shot by robbers for over $5,000,000. That was paid by the apartment management's insurance. Negligent security cases are much more complicated than a car wreck case. If you consult a lawyer, make sure you consult a lawyer who regularly handles negligent security cases. Ask them to give you a list of their most recent verdicts or settlements involving claims against apartments.

    Jeffrey’s Answer

You should retain an experienced wrongful death attorney to investigate this wreck. We handled a similar bicyclistversus vehicle collision and recovered multimillion dollars for the victims. The initial police report and witness statements claimed the bicyclist was at fault. However, once we retained a reconstruction expert and spoke with the witnesses directly, we were able to prove that the bicyclist was completely innocent. There is almost always more than meets the eye… Make sure you hire a firm with the resources and experience to delve into the details.

    Jeffrey’s Answer

Not a silly question at all. I Tell clients the number one driver of settlement or verdict value is the extent of injuries. The most important consideration now is to make sure that everyone gets the appropriate medical treatment. Injuries can take several days to manifest themselves. It's also very important to make sure that health insurance companies pay all of the bills. The hospital and medical providers will try to claim the car insurance company should pay for the treatment but that is not the case most often. If the injured victims do not have health insurance, a law you're can usually help negotiate medical treatment on a lean basis or make an introduction to a medical provider who will treat for free until the case is resolved.
