During the investigation, the driver performed the walk and turn evaluation with no clues indicated. The horizontal gaze nystagmus evaluation was not administered in the way the test was designed. Before arraignment, the solicitor agreed to reduce the charge to reckless driving and took a City Ordinance plea to the charge of open container.
