State of Georgia v. T.H.

Mark C. Burton

Case Conclusion Date:January 20, 2012

Practice Area:DUI / DWI

Outcome:Reduced to reckless driving

Description:The driver passed a Trooper in the left lane at a high rate of speed and changed lanes abruptly with his left turn signal on the whole time. Upon being asked, the driver said he had about 7 or 8 beers that day at a beerfest. When performing the walk and turn evaluation, the driver looked impaired. The driver provided a sample for the roadside alcosensor. After being arrested for DUI, the driver declined to provide a breath sample for the Intox 5000. Before trial day, the failure to maintain lane and DUI charges were dropped, and the defendant pled guilty to one count of reckless driving.
