  • If I was working for an employer, and had an accident while on the job, can the other person in the car sue me personally?

We've been served papers suing us directly based on a car accident. We have car insurance and so does the employer.

    Talal’s Answer

Yes, report the claim to your insurance company and forward a copy of the lawsuit to them immediately. They have the duty to defend you as an insured. Your attorney will make sure that your company's counsel is involved as well.

  • At fault auto accident in mo. Can I get jail time or probation? 1st offense....

1st offense no insurance ticket at fault accident.

    Talal’s Answer

Unlikely unless there was serious injury. You do have a large problem on your hands regarding the civil aspect of this situation. Seek local counsel immediately to discuss the case in detail as well at what options you may have available. Most importantly, buy some insurance!!!

    Talal’s Answer

At fault's insurance should cover the charges, however if you can afford it and want to mitigate the damages (since it may take awhile to open up the claim and have the other side accept liability) I would recommend that you pay it and then keep a copy of all receipts.

You should be able to easily recoup this money provided there is valid coverage on the claim.

  • Purchased a used car a "clean" Carfax report, attempted to trade in and accident shows up which wasn't on original report

Attempted to trade down a 2011 used vehicle and dealership informed us that Carfax shows it had been in an accident and airbag was deployed. This was not told to us at the time of the purchase, in fact the accident was reported to Carfax just 11 ...

    Talal’s Answer

If you relied upon the carfax report in your purchasing decision then you may have a claim. My suggestion is to meet with the dealer who sold you the vehicle and see if some arrangement can be worked out. If that does not yield the result you are seeking, seem local counsel to see the options you may have including a lawsuit. Reaching out to the media in cases like this is sometimes very powerful as well as it may cause bad publicity to the dealer in question.

    Best of luck!

File a complaint with the local police department (arresting agency)'s internal affairs division. Seek the advice of a civil rights attorney who handles these types of complaints to properly address all of your questions and possible claims.

    Best of luck.

    Talal’s Answer

I would recommend a police report, someone may be liable for theft by conversion. Otherwise a civil lawsuit. You could always report the incident to your insurance as well they may cover it with some type of coverage such as new car replacement.

    Talal’s Answer

Don't understand your question really well, but if you forgot your NTA and must appear at the hearing, sometimes the court will make a courtesy copy for you.

DO NOT miss your hearing date, a motion to reopen is very difficult and is nothing like a failure to appear in state court or municipal court (ie a traffic ticket). Good luck.

  • My son was involved in a 7 car no fault accident. He didn't hit anyone, but was pushed into a car. Can we sue with no fault?

He has two witnesses that said he avoided hitting the stopped car in front of him, but the two cars behind him did not stop and hit him. His car is totaled and he only has liability. Can we make the car behind us pay even if it's a no fault accident?

    Talal’s Answer

From your question, I am a little unclear of what you mean by 'no fault'. No one at all was at fault? If there was a 7 car pile up who initiated the chain reaction? Someone is at fault. Did you make a police report? If so seek a copy and talk to an experienced personal injury lawyer at once. Your son should seek immediate medical treatment as well.

Multiple car accidents can be difficult to resolve, get started immediately!

Did you suffer any permanent injury? Did you seek any medical treatment? If you have no damages then probably not.
