Description:I represented the former employer of a group of six employees who resigned and attempted to open a competing business and divert their former employer's customers to a newly-formed entity, all in violation of written non-compete agreements. The employees argued that the agreements were invalid. We convinced the judge to apply the "blue-pencil rule" and enforce the agreements as modified, which was the first time that this ever occurred in a reported case in South Carolina.
