Description:Mr. Ackerman represented Mr. Settles, a day-laborer hired by an out-of-state moving company. Mr. Settles was injured while working for the moving company, and his claim was denied by the employer and it's insurer, who cited a Virginia code provision exempting employers from Virginia WC law if the employer regularly has less than 3 employees working in Virginia. The Commission's ruling that Mr. Settles was entitled to WC benefits because the employer failed to prove it had less than 3 employees regulaly working in Viriginia was affirmed by the Virginia Court of Appeals and Supreme Court.
