Description: The Plaintiff had entered into a contract with the Defendant to sell her home at public auction. The Defendant agreed to provide all necessary forms in connection with the sale. At the sale, the Defendant failed to provide the successful bidder with the disclosure/disclaimer form required by state statute, and the bidder later demanded a reduction in the purchase price as a condition of his refraining from exercising a unilater recission right accorded to him by the state statute on account of the fact that he had never received the disclosure/disclaimer form.
