    It is a major mistake to represent yourself in a criminal prosecution. ARD may or may not be the best option for you. If you cannot afford a private attorney you should apply for a public defender.

    The most serious crime charged is aggravated assault. There are different subsection, but they are all felonies. The most serious carries a maximum penalty of 20 years in jail and a $25,000 fine. Your husband needs an experienced criminal defense attorney. If he cannot afford a private lawyer, he should apply for a public defender.

    It's not clear by your question whether you are being cited for driving with a DUI related suspension. Your lawyer has the most intimate knowledge of your case. Change lawyers if you have list confidence.

    There is a statute that permits retailers to bring suit to recover the cost of investigating retail thefts that occur in their stores. I advise all my clients that receive the same letter you received to NOT send any money. I have never seen a suit filed to recover damages but I guess there could be a first.

    If you plead guilty or are found guilty of this chage, there is an automatic 90 day license suspension. There are other options, therefore, you should retain a criminal defense attorney who will represent your interests in court and attempt to resolve the case without a conviction. Good luck.
