Never served my husband the divorce complaint costing me $70,000.00 in Superior Court

I hired Mr. Capristo to represent me in a Divorce Action. He filed the complaint in the Court of Common Pleas of Allegheny County but failed to serve the complaint on my spouse. Filing a complaint is not the only requirement to correctly commence an action; service of process must also be effectuat...ed. I assumed with Mr. Capristo's qualifications, experience and hourly rate, he would have followed the procedures required by law and served my husband. Mr. Capristo's error allowed my husband to contest venue in another county and it took five years to fight venue- eventually I had to appeal to Superior Court over the issue of venue. During the five years I could not collect child support or alimony. My total legal cost resulting from this was $69,555.00. I am still not divorced and have never had a hearing for child support or alimony.

Avvo Rating

Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals. Attorneys who claim their profiles and provide Avvo with more information tend to have a higher rating than those who do not.

What determines Avvo Rating?
  • Experience & background Years licensed, work experience, education
  • Legal community recognition Peer endorsements, associations, awards
  • Legal thought leadership Publications, speaking engagements
  • Discipline Disciplinary information may not be comprehensive, or updated. We recommend that you always check a lawyer's disciplinary status with their respective state bar association before hiring them.
