Probably even more difficult because in Buffalo there is so much snowfall its expected that public areas will be wet. Not fair but I wouldn't be surprised if thats what you're told by local lawyers. But don't give up. Give it a try.

This is a complex question. Legal malpractice involves proof that the lawyer failed to do what a competent lawyer would have done and that because of that you suffered a loss.

Please accept my humble sympathies. I think the terms you are using are ones your familiar with but may not be what they meant. You must be guardian to act on her behalf in most circumstances. But testifying is something different. In either event you should only rely on what your lawyer tells you. There are things you can't do for her without proper court documents. You already have some great answers. Police can be sued like everyone else. But, you will have to prove the accident was their fault just as you always have to. I guess the rest of the story got cut off. These type of incidents can be very infuriating when they happen to you. The legal issue for you is going to be whether that had probable cause if you were arrested. Probable cause can be complex. Basically they need a good reason to believe you had done something illegal. Call a lawyer if you were arrested. Someone experienced with civil rights cases. Good luck.
