This question is pretty straightforward. If you don't know if the fence is yours, then you don't know whether you may stain it. You will want to let your autombile insurance company know of the accident immediately and if you have been sued you should get a copy fo the suit to your insurance agent immediately. If youor your father do not have insurance coverage you should contact an attorney and bring a copy of the suit to them so they can protect your rights. First, a California lawyer can give you the best answer (I practice only in CT), but if you are named in a suit as an individual, a judgment can enter against you as an individual. If judgment enters against you, they can attempt to get at your assets.
