Case Conclusion Date: September 23, 2011
Practice Area: Appeals
Outcome: Affirmance of dismissal of all claims by District Court
Description: In this case, the United States Court of Appeals for the Second Circuit adopted our arguments on appeal, and affirmed the District Court below, dismissing all claims against our clients, an Indian corporation and three (3) individual Indian nationals. The litigation involved a commercial dispute between medical billing service outsourcers over the alleged misappropriation of proprietary corporate information by our clients, and included claims of tortious interference with business expectancies, violations of the Connecticut Unfair Trade Practices Act, defamation, slander per se, conversion and collusion to deprive Plaintiff of its business clients. In affirming the District Court, the Second Circuit agreed with us that exercising personal jurisdiction over our clients in the circumstances of this case would not comport with constitutional due process, and would offend traditional notions of fair play and substantial justice, thereby concluding the litigation in our clients’ favor.
