    The Defendant was accused of DWI. On the date in question the accused was followed by an Farmington Police Officer and stopped for speeding and two lane violations. The accused submitted to a three test battery of field sobriety tests and ultimately refused a breath test. At trial the State was unable to introduce the results of the SFSTs as the officer could not produce a sufficent foundation for thier introduction into evidence. In the absence of the SFSTs the Court granted a motion to exclude the refusal as evidence. The State rested and the Court granted a motion to dismiss.
