Why hasn't the DA filed charges felony assault after 3 months?
I was arrested for felony assault and trespassing charge three months ago in CA. I bailed myself out on 25k bond, but I have never been formally charged and it's been three months now. How did they set a bond without any formal charges in the first place?
You just have to lay off and wait. Without knowing the allegations and evidence against you, hard to see if matter may be dropped. I saw one case where, charges were never brought, where the defendant beat up his girlfriend and for some reason, charges were never brought but could be , at tnay minute.
What are you in a hurry? The DA has many cases and only a few deputies act as filing deputies to review reports from police agencies to decide what if anything to file. There could be a re-referral to the police for additional investigation ,or just a pile up of cases they haven't got to yet, there is also the possibility that they DA rejected your case. You can contact the DA to make inquiry or even better consult with a local attorney.
Please be aware that any comments that I have made are preliminary and tentative and not based upon a thorough analysis of your case. I would need additional information and review the exact documentation to be sure of the above advice. We cannot tell you why because they did not tell us. Maybe they are busy.
