What should I do? I live in Georgia.
I recently filed a chapter 13. My landlord refused to accept my rent payment. 20 days later he went to state court to file an eviction against me. I have proof of his refusal. I also told my attorney this and he stated that he was supposed to terminate it because he was in violation and that it was grounds for a Motion of Sanctions. Then my attorney comes back less than 3 days later stating that he made a deal and that the landlord will not do anything unless I'm not out of the house by the day that I gave my attorney. I recently received a call from the court stating that I now have a new court date because the landlord pushed it back. My attorney is letting this happen and I've stressed this to him. I feel like he's on my landlord's side with more than I can truly tell you all on this post.
My very learned colleague Attorney Bunce provided you with excellent advice. I agree there are missing facts from what you mentioned. If you do not like or worse yet, trust your attorney then retain a different very experienced GA Bankruptcy attorney to represent your interests in this matter. THIS IS NOT LEGAL ADVICE! YOU NEED TO SPEAK TO AN ATTORNEY WHO IS LICENSED IN YOUR STATE FOR LEGAL ADVICE. This is merely suggestions for you to think about in discussing your situation with the local attorney.

I hear the part of this story that you chose to share. I suspect that there is much more you haven't revealed, and those details, which you may have considered unimportant, are crucial to receiving an accurate answer. I don't want to represent someone who feels that I am on the side of a creditor, so if you were my client, I'd suggest that you replace me. Hope this perspective helps!
