What happens to a house if joint ownership during Chapter 7 bankruptcy?
My ex wife and I divorced back in 2021. In our divorce decree she took over the mortgage
payments for the house we purchased in 2020. She lives there with her new husband and our kids and has never been late on payments. Here is my conundrum: I need to file chapter 7 bankruptcy in a few months but do not want her to lose the house in my bankruptcy. My name is still on the loan. She has made all the payments and never been late so that would be unfair to make her sell! My kids live there as well so I cannot do that. So is there a way to exclude the house on my bankruptcy?
You need to retain an experienced VA mortgage foreclosure defense and bankruptcy attorney. There is no reason for your ex-wife and children to lose the home, if this is handled property. THIS IS NOT LEGAL ADVICE! YOU NEED TO SPEAK TO AN ATTORNEY WHO IS LICENSED IN YOUR STATE FOR LEGAL ADVICE. This is merely suggestions for you to think about in discussing your situation with the local attorney.
