What are the possible consequences for him and myself?

My 23 year old son was caught in my car passed out in a parking lot of a restaurant with an open container. The car is in my name but he pays the insurance on it. It is registered in my name as well. He was not moving. One of the employees in the restaurant called the cops on him. This happened in NJ but we are from NY state.This is his first offense. Other than this non moving violation he has a clean record. So do I.
