Supreme Court Ruling on Birthright Citizenship effect on interim baby?
What will happen to interim baby born between 20 Jan 2025 to 27 June 2025? My baby is born between this period and already got SSN & US passport. Is government going to take my baby's US CITIZEN rights from her?
There is no case before the U.S. Supreme Court on Birthright Citizenship. The Fourteenth Amendment to the U.S. Constitution is the one that addresses birthright citizenship. Specifically, Section 1 of the amendment states:
“All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. Supreme Court case United States v. Wong Kim Ark (1898) affirmed this interpretation, ruling that a child born in the U.S. to foreign nationals (not diplomats or occupying forces) is indeed a U.S. citizen.
Changing a long standing Constitutional Amendment is extremely difficult and I am aware that only the Constitutional Amendment that was changed was the 18th Amendment, which was changed by another Constitutional Amendment.
