Need guidance on filing F-1 COS after B-2 COS + one B-2 extension post-H-1B layoff
I originally came to the U.S. on an F-1 visa in 2016, completed my Master’s degree, and later transitioned to H-1B status, which I maintained properly until my layoff.
I was laid off from my H-1B role in March 2025.
Immediately after the layoff, I filed a B-2 Change of Status (COS).
USCIS approved that B-2 COS through July 2025.
Before that first B-2 period ended, I filed one B-2 extension.
USCIS approved the extension, and my B-2 status is now valid through January 2026.
So the sequence is:
H-1B → B-2 COS → B-2 Extension (one filing)
I have now been in B-2 status for about 9 months total.
Recently, I received an MBA acceptance for Spring 2026, and I am preparing to file an F-1 Change of Status.
I want to file it in regular processing so I can continue job searching while the F-1 COS is pending.
If I receive a job offer, I intend to file an H-1B transfer during the F-1 pending period.
My questions:
Is it advisable to file the F-1 COS now and continue job searching, then file an H-1B transfer if an employer is ready to sponsor?
Does a long period in B-2 (from one COS + one ext
The real, useful "guidance" you can expect during a private consultation and not in a general, voluntary blog such as this one. Anyhow, to generally answer your questions: Yes, you can file an F-1 Change of Status now and continue job searching.
Your long B-2 period (one COS + one extension, properly filed and approved) does not (yet) create a status problem for filing the F-1 COS.
If you receive a job offer before the F-1 is approved, you may immediately file an H-1B transfer (change of status back to H-1B) as long as you remain in a period of authorized stay.
The key is filing your F-1 COS before your current B-2 expires in January 2026 so your stay remains lawful while waiting.
