Is A deposit at A catering restaurant non refundable if no contract was signed and it doe's not say non refundable on the cash ?

We put A deposit for A party at A restaurant , The guest list grew making the room to small. When I went to cancel, they are saying they dont' have to give me back my deposit.

More information is needed to answer the question. Based upon the information you provided, the restaurant cannot just keep your monies. A correspondence needs to be sent to them at once outlining why you should be entitled to deposit, even partially. By not having a signed agreement, potentially subjects them to consumer fraud.

If there is no signed contract detailing the deposit and no oral agreement either then the deposit is most likely refundable. Problem now is though that you will most likely spend more money getting the deposit back than what the deposit amounts to. Seek local counsel for a more thorough review of your particular facts
