In ohio my house was auctioned and foreclosed on there's an excess fund around 40000 over what I own, how do I claim that mon?
My house was optioned going to 10th of October. I owe $95000. And it's sold for a 138. I was wondering how I collected the excess funds
You would need to file a Motion in the foreclosure case to have the funds distributed to you. Theoretically you could do this yourself, but it will go better if you hire a lawyer. Be wary of the vultures who contact you about this because they will charge you exorbitant fees to recover the money, which is actually quite a simple process if you know what you're doing.
The only way to properly obtain whatever surplus funds that you are owed is to retain an experienced OH mortgage foreclosure defense attorney, who has substantial experience in surplus funds recovery. THIS IS NOT LEGAL ADVICE! YOU NEED TO SPEAK TO AN ATTORNEY WHO IS LICENSED IN YOUR STATE FOR LEGAL ADVICE. This is merely suggestions for you to think about in discussing your situation with the local attorney.
