Question

I bought a house three weeks ago, and found undisclosed water damage/leak is it worth legal action.

I bought a house three weeks ago and ripped up the tile because it was done horribly and was uneven. The house had just been remodeled within the past 6 months. We immediately found wet concrete and a ton of thick waterproof sealant covering the seam in the concrete and the wet area. We have concluded that the water is from a back yard drainage issue. There is no way the sellers didn’t know of this issue and they tried to cover it up. We will have to remove everything, seal and waterproof the foundation, and add a French drain in the yard and hope the water pooling stops. Is it worth hiring a lawyer?

You may have a valid claim for Seller's failure to fully disclose this water intrusion issue. You should likely tender the damages claim to your insurance carrier and see if they cover you. You might be able to demand that the seller at least pay for your deductible if you incur one with your insurance company. Suing seller is going to cost time and money. You're looking at $20 to $60k in legal fees plus a few years to move the case through the court system. Doesnt seem to be worth it big picture if your damages are lower than the costs of suit.
