How easily can we get my husband as the legal father of my children?
We just got married, but he's been around for a while now. My ex has only supervised visitation through the county constable allowed(which he hasn't taken in the 6, almost 7 years that I have had custody). I had a TRO that led into the current order after CPS was involved following him punching our son in the face and a teacher calling after he came to school with massive bruise. He was only 7 at the time. He has not seen them sense. We have had support payments off and on from him, but that's just because I harass the OAG until they track him down every time. He is still over $10k in arrears. He never showed up to a single hearing for custody or any mediation. He has tried in the past to go around the custody to access them and then will push for me to let him sign away rights to get out of it all.
Well, now I have someone that wants to adopt. And the kids are 13 and 15 and very openly want him to adopt. I don't have any whereabouts of my ex now and I have not heard from him in the last 3 years. He's not in the same state and hasn't been since CPS pursued him for noncompliance in our case. I know I will need to get a family lawyer for this, but what are my chances here?
In general, pretty decent chances of a termination and adoption going through under the circumstances you laid out. There could be more details that might change that, but you'll want to discuss with an attorney before you file in any event.
