How do I ask/create a plea bargain? Does established a jury trial date mean I’m unlikely to get a plea offer from the state?
I have a DPD already established, I’m being charged with felony 6 theft. The court already established a jury trial date. Do I go through my public defender to ask state to negotiate a plea?
Well, it depends, but there are usually first offers at that time.
Do not stress if it is not what you want.
You cannot be forced into anything.
I'm licensed to practice law only in Indiana, and we've never met, so I can't give you "legal" advice. My answer is simply "friendly" advice based on my experience as an attorney in Indiana, my knowledge of federal and common law, and common sense. My answer is intended as general information only. It doesn't create an attorney-client relationship. Please check what I told you with a licensed experienced attorney. OR check with your attorney who handled the case. There could be more I need to know on this that you haven't told me, and that would possibly change my answer. Also, a final point: this is anonymous, I don't know who you are. Nothing keeps you from calling me if you want, but check the areas I practice in, that is the COUNTIES.
You are represented by an attorney, therefore the prosecutor is legally and ethically prohibited from talking with you. You should be discussing the case, a plea or trial with your attorney. If you have not already reached out to your PD, do so asap.
NO ATTORNEY CLIENT RELATIONSHIP has been created or established by this or any other response by Attorney Bennett on Avvo. Attorney Bennett is licensed in the State and Federal courts in Indiana. It is impossible to post/ask a question with sufficient facts or details about your situation to have an attorney construct a response on this or any other website that would fully and effectively address the legal question/issue posted. To have a more specific and appropriate answer to your question/issue you should contact a licensed attorney in your state.
As long as you are represented by a public defender, the State will NOT speak with you directly. They are required to communicate through your lawyer. You should be asking your PD about the possibility of a plea agreement.

Even if you are in Indiana, employment law questions are very fact specific, and based on the limited information you provided in your post, I can't give you legal advice, and my answer is intended as general information only. It doesn't create an attorney-client relationship.
